Please read these Terms and Conditions carefully before using our website or engaging Tenang's consulting services. By accessing our website or entering into an engagement agreement with us, you confirm that you have read, understood, and agree to be bound by these terms.
1. Definitions
- "Agreement" means these Terms and Conditions together with any written engagement confirmation.
- "Services" means the business consulting engagements offered by Tenang: Settling In, Steady Path Review, and Settled Partnership.
- "We / Us / Our" refers to Tenang, a business consulting practice registered in Malaysia.
- "You / Client" refers to the individual or business entity engaging our Services.
- "Engagement" means a specific consulting package entered into under a written or electronic agreement.
- "Written Outputs" means documents, roadmaps, reflections, or notes produced by Tenang as part of the Services.
2. Acceptance of Terms
By using this website or entering into a consulting engagement, you confirm that:
- You are at least 18 years of age
- You have the legal capacity to enter into a binding agreement
- You accept these terms on behalf of yourself or the business you represent
3. Service Description
Tenang provides business consulting services for small business owners, primarily based in Malaysia. Our three engagement types — Settling In (RM 710), Steady Path Review (RM 1,950), and Settled Partnership (RM 3,420) — are described on our website. The scope of each engagement is confirmed in writing prior to commencement.
Services are available in-person in George Town, Penang, and online via video call. Tenang reserves the right to decline any engagement enquiry at its discretion.
4. Your Responsibilities
- Provide accurate and complete information when engaging with our services or contact form
- Attend sessions at agreed times or give at least 48 hours' notice to reschedule
- Use our website and services only for lawful purposes
- Not attempt to reverse-engineer, copy, or reproduce any proprietary materials or written outputs beyond personal use
- Treat all communications with Tenang staff with professional courtesy
5. Intellectual Property
All content on this website — including text, structure, and design — is owned by Tenang and protected under applicable Malaysian intellectual property law. Written Outputs produced during engagements are provided to you for your personal business use. You may not reproduce, publish, or distribute them commercially without prior written consent from Tenang.
Our consulting methodology remains the proprietary approach of Tenang.
6. Payment Terms
- All fees are stated in Malaysian Ringgit (RM) and are inclusive of any applicable taxes
- Payment is required in full before the first session of each engagement
- Accepted payment methods will be confirmed at the time of booking
- Invoices will be issued by email prior to payment
Refund Policy:
- Cancellations made more than 7 days before the first session: full refund
- Cancellations made 3–7 days before the first session: 50% refund
- Cancellations made less than 3 days before the first session: no refund
- For multi-session engagements, refunds for remaining sessions may be considered on a case-by-case basis
7. Confidentiality
Information shared during consulting sessions is treated as strictly confidential by Tenang. We will not disclose client information to third parties without written consent, except where required by Malaysian law. Clients are similarly expected to keep any proprietary materials or approaches discussed during engagements confidential.
8. Disclaimers
Tenang's services are advisory in nature. We provide perspectives, frameworks, and written outputs to help you make informed decisions about your business. We do not:
- Provide legal, financial, accounting, or tax advice
- Commit to specific business outcomes or financial results
- Accept responsibility for decisions you make based on our advice
All services are provided in good faith based on the information available to us during the engagement.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, Tenang's liability to you for any claim arising from these terms or an engagement shall be limited to the fees paid for that specific engagement. We shall not be liable for:
- Indirect, incidental, or consequential losses
- Loss of revenue, profit, or business opportunity
- Outcomes of decisions made by you based on our advice
- Delays caused by circumstances beyond our reasonable control (force majeure)
10. Termination
Either party may terminate an ongoing engagement by giving 14 days' written notice. In the event of termination:
- Any sessions already completed will be invoiced and payable
- Written outputs already delivered remain yours to keep
- Prepaid fees for remaining sessions will be refunded on a pro-rata basis
Tenang reserves the right to terminate an engagement immediately if a client behaves in a way that is abusive, threatening, or materially in breach of these terms.
11. Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. In the event of a dispute, we encourage parties to attempt informal resolution first by contacting us at [email protected].
If informal resolution is not achieved within 30 days, disputes shall be referred to the courts of Pulau Pinang, Malaysia, which shall have exclusive jurisdiction.
12. General Provisions
- Entire agreement: These terms, together with the engagement confirmation, constitute the entire agreement between the parties.
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full effect.
- Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these terms without our written consent.
13. Changes to These Terms
We may update these terms periodically. Changes will be posted on this page with a revised effective date. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms. For active engagement clients, material changes will be communicated directly by email.
